An overview of the Italian and Spanish experiences” de Federico Della Negra, doctorando en Derecho bancario y financiero por el European University Institute (San Domenico di Fiesole, Italia).

El artículo aborda el impacto de las normas de conducta establecidas en la MiFID sobre el Derecho contractual nacional, y analiza los mecanismos diseñados en España e Italia para afrontar desde el punto de vista jurídico-privado los incumplimientos de dicha normativa y sus consecuencias sobre los inversores.

Tal y como señala el propio autor en el abstract de su interesante trabajo, “EU financial regulatory law is driven by a public-oriented approach and does not provide private law remedies for investors vis-àvis the investment firms. At EU level, the breach of the conduct of business rules gives rise only to public-administrative sanctions. Whereas supervision and public enforcement are vertically-centralised, private enforcement is horizontally-decentralised. Against this backdrop, it is argued that European regulatory and national contract law do not represent two separated and isolated ‘entities’. Starting from the Italian and Spanish experiences, it is submitted that national courts and other private enforcement mechanisms (eg ADR, arbitration) interpret national contract law in light of the financial regulatory law providing effective remedies to the investors.
